Boundary Dispute Over Konza City Escalates Between Machakos and Makueni

The counties of Machakos and Makueni are currently engaged in a dispute over the jurisdiction of Konza City, a significant development area in Kenya. The Ministry of Lands issued a directive to transfer land records of the Konza region from Machakos to Makueni by December 30, 2024. Machakos County has rejected this directive, asserting that Konza City remains within its boundaries.
Machakos Governor Wavinya Ndeti, through County Lands Executive Nathaniel Nganga and County Secretary Muya Ndambuki, expressed strong opposition to the Ministry's directive. They argue that the move attempts to alter county boundaries without following constitutional procedures. Nganga referenced a 2014 Senate report by the Standing Committee of Lands and Natural Resources, which he claims clearly delineates Konza City within Machakos County.

The directive from the Ministry of Lands, communicated via an internal memo dated November 19, 2024, called for the transfer of land records to the Wote land registry in Makueni County, effective December 30, 2024. This has raised concerns about potential boundary changes being implemented without due legal process.
Konza City, often referred to as 'Africa’s Silicon Savannah,' is a flagship project under Kenya’s Vision 2030 economic development portfolio. The technopolis is projected to be a world-class smart city powered by Information, Communications and Technology (ICT) infrastructure, with an estimated construction cost of Ksh1.2 trillion. The project's significance has heightened the stakes in the jurisdictional dispute between the two counties.
As of now, the Ministry of Lands has not publicly responded to Machakos County's refusal to comply with the directive. Additionally, there has been no official statement from Makueni County regarding the situation. The resolution of this dispute will require careful navigation of constitutional provisions concerning county boundaries and intergovernmental relations.
